MMONUMENTAL SPORTS & ENTERTAINMENT FOUNDATION – WASHINGTON CAPITALS 50/50 RAFFLE

OFFICIAL RULES

Official Rules. Monumental Sports & Entertainment Foundation (Foundation) will conduct a 50/50 Raffle (each, a Raffle) at Verizon Center during certain regular-season and postseason home games of the Washington Capitals as the Foundation may elect. Only one Raffle will be held during any particular game. By participating in a Raffle, entrants agree to be bound by these Official Rules and by the decisions of the Foundation, which shall be binding and final as to all matters related to the Raffle. Each Raffle is subject to all applicable federal, state and local laws and is void where prohibited.

Eligibility. Each Raffle is open to all persons age 18 and older and subject to these Official Rules. The following persons are NOT ELIGIBLE to participate in a Raffle or to win any Prize: Employees, officers, directors and board members of the Foundation and any non-uniform, front office employees of the Washington Capitals, Verizon Center and Monumental Sports & Entertainment.

Purchasing Tickets. On any date that a Raffle is occurring, Raffle tickets (Tickets) will be sold at designated kiosks and by roving sellers at Verizon Center from the time its doors are opened to the public through the earlier of the end of the third period. Tickets may be purchased as follows: three tickets for $5.00; 10 tickets for $10.00; and, 40 tickets for $20.00. Tickets will be available for purchase in person only and must be purchased with cash in U.S. dollars. There is no limit to the number of Tickets an individual may purchase; provided, however, that if the amount of a Prize reaches $150,000.00, no additional Tickets will be offered for sale. Each entrant will receive a receipt corresponding to his/her purchase. The Foundation is not responsible for printing errors in any Raffle-related material or any misdirected, incomplete, lost, late or illegible Tickets or other errors or problems which may limit an entrant’s ability to participate in or win a Raffle. All Ticket purchases shall be final, and no refunds or replacements will be issued by the Foundation. Tickets are only valid for the drawing held on the date of purchase. 

Raffle Tickets are Not Tax Deductible. The IRS has taken the position that amounts paid for chances to participate in raffles, lotteries or similar programs are not gifts and, therefore, the price of the entry does not qualify as a deductible charitable contribution.

The Prize. Half of the amount of the gross proceeds from the sale of Tickets to each Raffle (as determined by the Foundation in its sole discretion) shall constitute the Raffle’s prize (Prize). The other half shall be retained by the Foundation for the benefit of Monumental Sports & Entertainment Foundation. $150,000.00 is the maximum amount of any Prize.

Selection of the Winning Ticket. During the third period, one Ticket will be randomly drawn utilizing automated software to determine the winner of the Prize. The holder of the winning Ticket does not need to be present at the time of the drawing in order to win. The winning Ticket will be announced at Verizon Center during the third period and listed on the Foundation’s webpage at www.monumentalfoundation.org/5050, and recorded on the Raffle hotline at 202.628.3200 extension 1550.

Taxes. Each winner shall be responsible for any and all federal, state and local income or excise taxes, fees, assessments and like charges associated with a Prize. At the time of this printing, federal law requires that tax withholding on certain prize values must be collected from winners upon award and distribution. Federal, state and local withholding laws are subject to change without notice. The withholding laws in effect at the time each Prize is claimed will be followed.

Claiming a Prize. Within 90 calendar days of a drawing, the holder of the winning Ticket in any Raffle must do the following, in person: (1) present the winning Ticket; (2) complete and sign the Affidavit, Prize Claim and Release (Release); and (3) complete and sign all applicable tax forms. Ticket holders may complete these steps at Verizon Center during any Capitals home game when a Raffle is occurring by visiting the Guest Services hub at Section 115, or by emailing 5050@monumentalsports.com to schedule an appointment to visit the Foundation’s office on a non-holiday weekday between 11 a.m. and 3 p.m.  Once those steps have been timely completed, the Foundation will mail a check, within 30 days, to the winner identified on the Release at the address identified on the Release. The amount of the check will equal the amount of the Prize less any applicable tax withholding (as described in Section 7 above). For security and safety reasons, no cash payments will be made. In the event that the holder of the winning Ticket: (a) does not complete steps (1) through (3) above; (b) is ruled ineligible for any reason; or (c) refuses the Prize, the Prize will be forfeited and will be retained by the Foundation for charitable use. In the unlikely event that an error or problem in the administration of a Raffle results in more than one Ticket purchaser holding a Ticket that has the winning number, the person holding the Ticket that was purchased the earliest shall be deemed to hold the winning Ticket. A Ticket is void and its holder is ineligible to win the Prize if there is sufficient evidence, in the sole discretion of the Foundation, that the Ticket was improperly issued, printed in error, counterfeited, stolen, illegible, altered or subject to other deficiencies, and the Foundation will have no liability with respect to any such Ticket.

Transfer and Resale of Tickets.  Purchasers of Tickets may opt to give away their Tickets to other eligible persons, but in doing so the purchaser waives any claim he/she might otherwise have to the Prize. The Foundation shall conclusively presume that the person who is in possession of the winning Ticket is the lawful owner of that Ticket and that Ticket’s winning number. The Foundation shall not make, nor have any duty to make, any inquiry whatsoever into the circumstances under which the person holding the winning Ticket came into possession of it. Purchasers of Tickets may not re-sell their Tickets to others, and may not knowingly give Tickets to others for the purpose of allowing those others to re-sell such Tickets. All Tickets that have been resold in violation of these Official Rules shall be void and all individuals who re-sell, purchase, or receive Tickets in violation of these Official Rules shall be ineligible to participate in the Raffle or to win a Prize.

Odds. The odds of winning a Raffle depend on the number of Tickets purchased.

Release of Liability. By entering into a Raffle, all entrants agree to: (a) be bound by these Official Rules; and (b) release the Foundation, Washington Capitals, the other NHL Entities, Verizon Center, DC Arena LP, Lincoln Holdings LLC dba Monumental Sports & Entertainment, and each of their respective parent corporations, subsidiaries and affiliates, together with their owners, partners, members, employees, officers, directors and agents (collectively, the Released Parties), from any and all liability with respect to any injury, damage or loss that may occur, directly or indirectly, in whole or in part, from the participation in the Raffle or from any travel or activity related to the receipt or use of any Prize. The NHL Entities shall mean the National Hockey League, NHL Enterprises, L.P., NHL Enterprises Canada, L.P., NHL Enterprises B.V., the Member Clubs of the NHL, and their respective affiliates, partners, limited partners, general partners, officers, directors, parents, successors, assigns, representatives, and agents, including advertising and promotion agencies. 

 

General Conditions. Each Raffle will be conducted and supervised by the Foundation, whose decisions are final. Failure to enforce any provision of these Official Rules shall not constitute a waiver of that or any other provision by the Foundation. The Foundation reserves the right to modify these Official Rules at any time. The Foundation reserves the right, in its sole discretion to cancel or suspend the Raffle should unauthorized human intervention or other causes corrupt the administration, security, fairness, integrity or proper operation of the Raffle. The Released Parties are not responsible for: (a) Tickets that are lost, stolen, damaged, illegible, given away or no longer in the purchaser’s possession; (b) Tickets that have been or may have been tampered with or re-sold in violation of these Official Rules; (c) Tickets or payments that are delayed, misdirected, or undelivered as a result of any failure or problem with the availability, functionality, operability or use of any network, server, ISP, website, computer, internet connection, hand-held mobile device or any other equipment or connection used in connection with a Raffle; and, (d) any other errors of any kind, whether human or otherwise, related to a Raffle, including, without limitation, errors in identifying potential winners, errors in the administration of the Raffle or errors in any Raffle-related materials.

Publicity Release. Each winner, by accepting a Prize, grants the Foundation and its designees and affiliates, including, without limitation, the Washington Capitals, full permission, except where legally prohibited, to use such winner’s name, address (city and state only), photograph, voice and/or other likeness, and prize information for advertising, trade and promotional purposes without further compensation and without notice, review or approval, in all media now known or hereafter discovered, worldwide and in perpetuity. Each winner shall execute all documents that the Foundation may require in connection with this release.

Governing Law & Dispute Resolution. The Raffle and these Official Rules shall be subject to and governed by the laws of the District of Columbia. If a court of competent jurisdiction finds that any provision of these Official Rules, or their application to a particular person or circumstance, is invalid or unenforceable to any extent, then the remainder of these Official Rules shall remain enforceable to the fullest extent permitted by law. The venue for any cause of action arising out of a Raffle or these Official Rules shall be located in the District of Columbia.

Copyright. All Raffle-related materials are copyrighted by the Foundation, and may not be copied, reproduced or used for any purpose without the Foundation’s prior written consent.

The Foundation. The Foundation is a non-for-profit corporation, which enjoys tax exempt status and raises money for distribution to charitable organizations. Lincoln Hockey LLC is a Delaware limited liability company, which owns and operates the National Hockey League team known as the Washington Capitals. While the two entities are affiliated, each is a separate legal entity, distinct from the other. The Foundation is conducting the Raffles at Verizon Center with the permission of the Washington Capitals, but the Foundation is solely responsible for the operation and conduct of the Raffles. Official Rules. How to Claim a Prize

Please visit the Guest Services hub at section 115 on the main concourse before the end of the game. To claim a prize at any other time, contact Monumental Sports & Entertainment Foundation’s office at 202.266.2200 or send an email to 5050@monumentalsports.com. The holder of a winning ticket has 90 days from the date of the drawing to claim their prize. Prizes must be claimed in person by presenting the winning ticket and signing applicable tax forms and an Affidavit, Prize Claim and Release. Winners are responsible for all applicable taxes and the cost of tickets is not tax deductible.
